3D User License Agreement

Pyware 3D User License Agreement - Version 11 - 6/1/2021

The customer is granted a non-exclusive, non-transferrable License to install and run this software and documentation subject to the restrictions and terms set forth in this agreement. The only right granted the customer is the right to install and run this software. Customers who have purchased a 3D Basic Single User license may install and locally run this software on two computers. Customers who have purchased a 3D Professional Single User license may install and locally run this software on three computers. Customers who have purchased a 3D Professional Lab Package license may install and run this software at one site (location) on a number of computers predetermined in writing with Pygraphics. Remote access and operation of this software requires prior written permission by Pygraphics.

The Pyware Cloud Services 3-year Subscription is required with the Version 11. The renewal of this subscription is required to maintain access to the Pyware 3D software. Subscription Features include: Annual Java support license, remote Design Team Collaboration Management System, cloud storage on each user’s Portal, Real View Asset Store membership, remote live 3D mobile app drill data updating. The subscription will need to be renewed 3 years after the date of purchase.

The customer shall take all reasonable efforts to prevent the piracy of this software. The customer agrees to contact Pygraphics in writing of any unauthorized use of this software.

When the customer is a business, institution or school, it is the customers responsibility to insure this software is deinstalled from an employee’s computer who is no longer employed by the customer.

The customer may not modify, translate, copy, reproduce, reverse engineer, or use it in any manner that infringes with the intellectual property of Pygraphics.

The customer agrees to communicate the terms and restrictions contained in this License Agreement to all persons who have access to this software.

Any failure to comply with the terms and conditions of the License Agreement shall result in automatic termination of this license.

Patent & Copyright

This software program and all instructional material are protected by U.S. Patent and Copyright laws. Unauthorized reproduction and/or sales may result in criminal penalties. Patent & Copyright infringer may also be subject to civil liability. These items are intended for use by the original owner only. Except for personal use, they may not be reproduced in any medium, for any other application, without prior written permission by Pygraphics.

Warranty

Pygraphics warrants the original purchaser only that the original program disks will be free from defects under normal use for a period of ninety (90) days following the date of purchase. If a defect is discovered during this period, Pygraphics will replace the defective disk without charge provided you have registered this product within thirty (30) days of purchase date.

Pygraphics further warrants that this program will perform substantially in accordance with the authorized advertising. In the event Pygraphics is notified, within thirty (30) days of purchase, of a significant program error, Pygraphics will correct the problem within a reasonable time. If the problem cannot be corrected, Pygraphics will provide or authorize a refund.

Except as provided herein, the entire risk as to the results and performance of this software program is assumed by you. This warranty gives you specific rights and you may also have other rights which vary from state to state. Pygraphics liability shall not in any case exceed the purchase price for the software claimed to be defective.

Pyware 3D™ uses Vorbis SPI for Ogg audio playback. This library uses the Tritonus, Jogg, and Jorbis libraries all of which are distributed under the LGPL.

A copy of this license will be installed inside the program’s application folder.
